Terms of Service

1. Acceptance of terms

These Terms of Service ("Terms") govern your access to and use of AME — the Autonomous Marketing Engine (the "Service") — operated by Smart Growth Auto ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

2. The service

AME (Autonomous Marketing Engine) is an autonomous marketing platform that uses artificial intelligence to generate, schedule, publish, and optimise social media content across connected platforms. Features and functionality may change over time as we improve the Service.

3. Accounts & eligibility

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for the accuracy of your account information and for keeping your credentials secure.
• You are responsible for all activity that occurs under your account and within your organization.
• A single administrator account governs each organization; you are responsible for users you invite.

4. Credits & billing

The Service operates on a pay-as-you-go credit model. There is no subscription or recurring charge.

• Free credits — new accounts receive a one-time bonus of free credits to start. Free credits have no cash value and are non-refundable.
• Credit packs — you may purchase credit packs (currently Starter, Growth, and Scale). Prices are shown at checkout and may change at any time; changes do not affect credits already purchased.
• Consumption — credits are consumed when you generate text or images and use platform features. Estimated costs are shown in the app.
• Expiry — purchased credits do not expire while your account remains active.
• Payment — payments are processed by PayPal. By purchasing, you authorise the charge for the selected pack.
• Refunds — refunds are governed by our Refund Policy.

5. Acceptable use

You agree not to use the Service to:

• Violate any law or the terms of any connected social platform.
• Generate or publish content that is illegal, infringing, deceptive, hateful, harassing, or otherwise abusive.
• Send spam or engage in inauthentic or manipulative platform behaviour.
• Attempt to disrupt, reverse engineer, or gain unauthorised access to the Service or its infrastructure.
• Resell or provide the Service to third parties except as permitted for agency use of your own client accounts.

We may suspend or terminate accounts that violate these rules.

6. Your content & AI output

You retain ownership of the content and brand materials you provide. As between you and us, you own the content generated for you through the Service, subject to the terms of the underlying AI providers.

AI-generated content may be inaccurate or unsuitable. You are responsible for reviewing all content before it is published and for ensuring it complies with applicable laws and platform policies. You can keep manual approval controls enabled at any time.

7. Connected platforms

The Service publishes to third-party platforms that you authorise. Your use of those platforms is governed by their own terms and policies. We are not responsible for changes to, or the availability of, third-party platform APIs, and we cannot guarantee that any given post will be delivered.

8. Our intellectual property

The Service, including its software, design, and trademarks, is owned by Smart Growth Auto and protected by applicable laws. These Terms do not grant you any right to our intellectual property except the limited right to use the Service.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will achieve any particular marketing result.

10. Limitation of liability

To the maximum extent permitted by law, Smart Growth Auto will not be liable for any indirect, incidental, special, or consequential damages, or for lost profits or revenues, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months preceding the claim.

11. Termination

You may stop using the Service and request account deletion at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. On termination, your right to use the Service ends; sections that by their nature should survive (such as billing records, disclaimers, and liability limits) will survive.

12. Governing law & changes

These Terms are governed by the laws of the jurisdiction in which Smart Growth Auto is established, without regard to conflict-of-law rules. We may update these Terms from time to time; the updated version will be posted here with a revised "Last updated" date, and continued use of the Service constitutes acceptance.
